Why WHS is a scored criterion, not a compliance box

On Australian government and council civil tenders, WHS and safety management typically carry around 10–15% of the evaluation weighting as a standalone non-price criterion — and on many tenders a score below the threshold on a weighted criterion eliminates the bid entirely.1 That makes WHS one of the highest-stakes sections in the whole submission: it can win you marks, and it can also disqualify you outright.

The reason WHS is scored so seriously is that it doubles as a proxy for delivery competence. An evaluator reading a project-specific, well-structured safety response is looking at a contractor who understands their site, their hazards, and their legal duties. A contractor who pastes in a generic safety manual is signalling the opposite. As with the methodology statement, the WHS response is assessed as evidence of capability — not as a formality. SWMS, WHS Management Plan, WHS Management System: what’s the difference?

These three terms are routinely confused, and conflating them in a tender response is an immediate credibility loss. They operate at different levels.

The hierarchy matters: your management system (ideally ISO 45001-certified — see our ISO trifecta guide) sets the framework; the management plan applies that framework to a specific project; and the SWMS controls each specific high-risk task within it. What is high-risk construction work, and when is a SWMS mandatory?

The model Work Health and Safety Regulations define 18 categories of high-risk construction work (HRCW) — activities with the greatest potential for serious injury or death. A Safe Work Method Statement must be prepared before any of these activities begins, and a principal contractor must obtain the SWMS before the work starts.2 Preparing the SWMS after work has commenced is a breach of the Regulations.

Several HRCW categories are routine on civil sites, which is why almost every civil package triggers SWMS obligations. The categories most relevant to civil construction include work that involves:3

The practical point for tendering: identify, in your response, which HRCW categories this specific project triggers, and confirm a SWMS will be prepared for each before work begins. That single move demonstrates you have actually read the scope through a safety lens.

What must a SWMS contain — and why generic SWMS fail

A SWMS is not a procedure manual. It is a focused tool that, for each high-risk activity, sets out:2

  • The high-risk construction work being carried out.
  • The hazards arising from that work.
  • The control measures to be put in place (applying the hierarchy of controls).
  • How those control measures will be implemented, monitored, and reviewed.

Critically, a SWMS must reflect the specific workplace where the work is carried out. Safe Work Australia is explicit that a generic SWMS used across different workplaces may not meet the requirements of WHS law unless it has first been reviewed against the hazards and risks at the specific site and amended as necessary.2 This is both a legal point and a tendering point: an evaluator who sees an obviously generic SWMS attached to your bid reads it as a contractor who treats safety as paperwork.

The penalty stakes are real. Failing to prepare a SWMS before high-risk construction work begins is a breach of the WHS Regulations, exposing a PCBU to enforcement notices, on-the-spot fines, and prosecution.3 Evaluators know this — which is why a credible, site-specific SWMS approach reassures them you will not become their compliance problem.

What must a WHS Management Plan include?

For construction projects, the principal contractor must prepare a written WHS Management Plan before work commences. The trigger is the definition of a “construction project” — work where the cost of the construction is $250,000 or more.4 Much civil government and council work clears that threshold, so the WHS Management Plan is a standard requirement on the kind of contracts civil SMEs chase.

The model WHS Regulations and Safe Work Australia’s Construction Work Code of Practice require the plan to include, at a minimum:45

  1. Roles and responsibilities — the names, positions, and health-and-safety responsibilities of everyone at the workplace with specific WHS roles in the project.
  2. Consultation and coordination arrangements — how the parties on site (principal contractor, subcontractors, other PCBUs) will consult, cooperate, and coordinate to meet their WHS duties.
  3. Incident management arrangements — how WHS incidents at the workplace will be managed.
  4. Site-specific safety rules — and the arrangements for making sure everyone at the workplace is informed of them.
  5. SWMS arrangements — how Safe Work Method Statements will be collected, assessed, monitored, and reviewed across the project.

The plan must be written so it is easy to understand, signed and dated by the principal contractor, communicated to the relevant people, kept available for inspection for the life of the project, and retained for at least two years after any notifiable incident.4 Naming these obligations in your tender response — and confirming you meet them — is direct evidence of competence.

How to write the WHS section of a tender so it scores

The single biggest WHS tendering error is attaching your generic WHS manual and treating the criterion as answered. It is not — and evaluators penalise it. To score in the competitive range, your WHS response should do the following:

  1. Lead with your system, then make it project-specific. Open by stating your WHS management system and any AS/NZS ISO 45001 certification, then immediately pivot to this project: its hazards, its HRCW triggers, its controls.
  2. Identify the project’s specific high-risk work. List the HRCW categories this scope triggers (trenching over 1.5m, work near live traffic, powered mobile plant, work near services) and state that a site-specific SWMS will be prepared for each before work begins.
  3. Map hazards to controls using the hierarchy of controls. For the project’s key risks, show elimination and engineering controls first, not just PPE and “be careful.” This demonstrates genuine WHS literacy.
  4. Show the management-plan structure. Confirm the WHS Management Plan you will implement and summarise its contents against the five required elements above — it tells the evaluator you know the legal standard and meet it.
  5. Demonstrate consultation, induction, and monitoring. Site inductions, toolbox talks, pre-start meetings, inspections, and incident reporting — the live machinery of safety on site, not just documents.
  6. Provide evidence of your safety record. Quantify it: LTIFR, time since last notifiable incident, audit results. Numbers are far more persuasive than claims of being “committed to safety.”
  7. Integrate WHS with the methodology. Your safety approach should be consistent with the construction sequence in your methodology statement — for example, trench safety controls that match the drainage sequence in your method. Inconsistency between sections is noticed and penalised.

Common WHS tender mistakes

  • Attaching a generic manual. The most common and most penalised error. The criterion asks for a project-specific approach, not your corporate policy.
  • Confusing the three documents. Treating a SWMS, a WHS Management Plan, and a management system as interchangeable signals a shallow understanding of WHS obligations.
  • Not identifying the project’s HRCW. Failing to name which high-risk activities this specific scope triggers — the clearest sign the contractor has not read the work through a safety lens.
  • PPE-first control thinking. Jumping to hard hats and hi-vis instead of leading with elimination and engineering controls in the hierarchy.
  • No safety record evidence. Claiming a strong safety culture without an LTIFR, an incident history, or audit results to back it.
  • Contradicting the methodology. A WHS response that doesn’t line up with the construction sequence or the plant in the rest of the bid.
