The diesel tank arrives on the back of a truck at site establishment, gets craned into a corner of the compound, and is filled by a delivery every week or two for the rest of the job. Nobody applies for anything, nobody measures a distance, and the only paperwork is the delivery docket.
That is how most civil sites do it, and most of the time nothing goes wrong. But bulk fuel storage is regulated as dangerous goods in every Australian jurisdiction, with quantity thresholds that trigger notification, licensing, placarding, manifests and separation requirements — and a diesel spill into a waterway is one of the most serious environmental offences a civil contractor can commit.
This guide covers what the tank actually is in regulatory terms, the requirements that attach as quantities rise, the environmental exposure, and how to set it up so it is not a problem. Why this is a regulated activity and not a plant item
Dangerous goods storage and handling is regulated under work health and safety and dangerous goods legislation in each state and territory, using a nationally consistent classification system but with jurisdiction-specific administration.
- Obligations scale with quantity. Below the first threshold you still have general duties; above it, specific requirements attach; above higher thresholds, notification or licensing.
- The duties sit with the person storing the goods, which on a construction site is generally the contractor who brought the tank.
- They apply on a temporary site as they do at a depot. There is no construction exemption for having a tank on a job for six months.
- Environmental legislation applies in parallel, and the environmental consequence of a spill is usually more serious than the dangerous goods consequence.
- The client’s requirements may exceed the law, particularly on operating sites, water authority land and near waterways.
This guide states no quantity thresholds, separation distances, bund capacities or placarding triggers. They are set in the dangerous goods regulations and codes in each jurisdiction, they differ, and the whole point of the thresholds is that the correct one depends on the class of goods, the quantity, and where you are. Take them from your regulator for the jurisdiction of the site — the same routing as our guide to contractor licensing by state.
The dangerous goods a civil site actually holds

The item most often mishandled is petrol in jerry cans. It is treated as trivial because the quantity is small, but it is a far more volatile product than diesel, and cans stored in a hot ute tray or an unventilated container are a genuine hazard. If nothing else changes after reading this guide, move the petrol.
Thresholds, and the fact that they stack
Dangerous goods obligations are quantity-based, and the structure is consistent even though the numbers are not.
- Below the first threshold — general duties apply: safe storage, safety data sheets available, spill response, competent people.
- Above a placarding threshold — outer warning placards and class placards, an emergency plan, and notification to the fire authority in some jurisdictions.
- Above a manifest threshold — a manifest of goods held, kept in a specified location and accessible to emergency services, plus notification to the regulator.
- Above a licensing threshold — a licence to store or handle, with conditions.
Two things about thresholds catch civil contractors out.
First, quantities aggregate. The threshold is generally assessed against the total of a class held at the site, not against a single container. A site tank plus a service truck plus jerry cans plus the fuel in plant may total something quite different from what anyone has considered. Whether fuel in the tanks of vehicles and plant counts differs by jurisdiction and is worth confirming.
Second, thresholds differ sharply by class. Diesel is a comparatively low-hazard product with relatively high thresholds; petrol and LPG have much lower ones. A site holding a modest amount of petrol may cross a threshold that a much larger diesel holding does not.
Self-bunded tanks and what “compliant” means
Most civil sites now use a self-bunded tank — a double-walled unit with the containment built in. They are the right answer, and “self-bunded” on a hire docket is not the same as compliant on your site.
- The tank should be built to the applicable Australian Standard for its type, and the supplier should be able to produce evidence of that rather than an assurance.
- The interstitial space between the walls needs to be monitored or inspected, because a leak into it is invisible from outside.
- Fittings are where leaks occur — hoses, nozzles, valves, vents and the fill point — and those are outside the bund. A drip tray under the dispensing point is the control.
- Overfill protection and a working level indicator, since overfilling during delivery is a common spill cause.
- Vent and fill point arrangements that suit the delivery vehicle.
- Earthing and bonding where required for the product.
- Fire protection — extinguishers of the right type, accessible, and inspected.
- Signage — class labels, no smoking, no naked flames, emergency contact.

Where a tank is not self-bunded, the bund is yours to build, sized to the applicable requirement, impermeable, able to exclude rainwater or with a controlled means of removing it, and maintained. A bund full of rainwater has no containment capacity left, which is a state most site bunds reach within a month of nobody looking at them.
Siting: separation, water and the things nearby
Where the tank goes is decided at establishment, in about thirty seconds, usually on the basis of where the truck can reach. It is worth thirty minutes.
- Distance from waterways, drains and pits. The most important siting decision. A tank uphill of a stormwater pit is a spill that reaches a waterway; the same tank thirty metres away with a fall away from the drain is a spill you can contain.
- Separation from ignition sources, buildings, boundaries and other dangerous goods, to the distances in the applicable code.
- Separation from excavations, which can channel a spill and which can undermine the tank base.
- Away from traffic routes, so it cannot be struck by plant — and protected by bollards where it cannot be.
- On stable, level ground capable of carrying a full tank.
- Accessible to the delivery vehicle without reversing across the site.
- Accessible to emergency services, and visible from the site entry.
- Not in a flood-prone position, which on civil sites near waterways is a real consideration.

Spill containment and response
The spill that matters is rarely a catastrophic tank failure. It is a hose left running, a fitting that weeps, an overfill during delivery, or a hydraulic burst on a machine near a drain.
- Spill kits sized for the quantity held, located at the tank, at the refuelling point and on plant working near water — not one kit at the compound.
- Drain protection — covers or plugs for nearby pits, and people who know where they are.
- A written first action, which differs for a spill to land and a spill to water, and which everyone knows without reading.
- Absorbed material is waste, and it is classified waste — see demolition and site clearing for the classification framework.
- Contaminated soil from a spill to ground must be removed and disposed of, which is a far larger job than the spill suggests.
- Notification. A spill to waters, or one of a size prescribed by the environment legislation, generally requires notification to the environment regulator within a short period. That obligation is separate from any WHS notification, and failing to notify is commonly an offence in itself.
- Practise it. A spill scenario at a pre-start takes five minutes and reveals whether anyone knows where the kit is.
Refuelling is the highest-risk routine activity, and it is usually done at the start or end of a shift by someone in a hurry, in the dark. Attended refuelling, a drip tray, an automatic shut-off nozzle, and a rule against leaving a running hose unattended cover most of it.
Moving fuel, which is a separate regime again
Carrying fuel by road is regulated separately from storing it, under dangerous goods transport law, and civil contractors do it constantly without considering it.
- Quantity thresholds apply to transport too, above which the vehicle requires placarding, the driver requires a dangerous goods licence, and the load requires documentation.
- Service trucks with fuel pods frequently sit near or above those thresholds.
- Moving a site tank between jobs with product in it is transporting dangerous goods.
- Jerry cans in a ute are usually below the threshold but still require secure, ventilated carriage.
- Segregation of incompatible goods in the same vehicle — oxygen and fuel, gas cylinders and liquids.

Check whether your service truck configuration crosses a transport threshold, because the answer determines whether your driver needs a licence they may not have.
The other dangerous goods on site
- Gas cylinders — stored upright, secured, in ventilated locations, with oxygen separated from flammable gases. Cylinders inside a shipping container is a common and poor arrangement.
- Oxy-acetylene sets with flashback arrestors, checked.
- Chemicals in the workshop and on vehicles, where aggregate quantities creep up and incompatible products sit together.
- Safety data sheets for every hazardous chemical, current, accessible to workers, and actually read by the person handling the product.
- A hazardous chemicals register, which is a straightforward requirement and one of the most commonly missing documents in a civil safety system.
- Decanting and labelling — product in an unlabelled container is a genuine hazard and a compliance failure.
- Lime and cement, which are hazardous substances requiring controls, as noted in our guide to pavement stabilisation, testing and conformance.
The environmental exposure, which is the big one
Set aside the dangerous goods requirements for a moment. The reason to take fuel storage seriously is that a hydrocarbon release to water or ground is among the most serious and expensive things that can happen on a civil site.
- Pollution offences carry substantial penalties in every jurisdiction, and they can attach to the company and to individuals.
- A visible sheen on water is reported immediately by the public, and it is unambiguous evidence.
- Remediation of contaminated ground is expensive, slow, and requires specialist involvement — see landfill and remediation civil works.
- Contaminated groundwater turns a spill into a long-running problem, as discussed in our guide to dewatering, water take and discharge.
- The client’s approvals are affected. On a site operating under an environmental approval, a spill is a breach with consequences for the principal as well as you — the framework in our guide to environmental approvals and permits.
- Insurance may not respond. Gradual pollution is commonly excluded from liability policies, and sudden and accidental cover has limits. Confirm the position with your broker rather than assuming.
- It is disclosable. An environmental prosecution or notice is a prequalification question, as our guide to civil contractor prequalification sets out.
The controls that prevent nearly all of it are cheap: site the tank away from drainage, use a self-bunded unit with a drip tray at the dispensing point, keep the bund empty of water, have spill kits where the risk is, and refuel attended.
Security, theft and the tank as a target
The tank is simultaneously a compliance obligation and the most stolen-from asset on a civil site, and the two overlap.
- Locking and anti-siphon devices, and a metered dispensing system requiring a plant number.
- Siting for visibility, which serves both spill response and deterrence.
- Removing the tank over extended shutdowns rather than leaving a full one on an empty site.
- Reconciliation, which detects both theft and leaks — a slow loss into the interstitial space looks exactly like slow theft, and only a dip reconciliation distinguishes them.
That last point is the one worth remembering. A contractor who assumes an unexplained fuel loss is theft may be missing a leaking tank, which is a far more serious problem. The full treatment is in our guide to plant theft and site security.
Manifests, placards, SDS and the records
- A hazardous chemicals register listing every hazardous chemical held, with its safety data sheet.
- Current safety data sheets, accessible where the chemicals are used, not only in the office.
- A manifest where quantities require one, in the specified location and format, accessible to emergency services.
- Placards where required, correct for the class, on the container and at the site entry.
- Notification or licence where thresholds require it, obtained before the goods arrive.
- An emergency plan covering the dangerous goods held, provided to the fire authority where required — integrated with the arrangements in our guide to emergency preparedness and site rescue.
- Inspection records for the tank, bund, fittings and fire equipment.
- Training records for people handling and refuelling.
- Delivery dockets and reconciliation, which also serve the fuel tax credit substantiation in our guide to fuel tax credits.
Pricing and setting it up properly
- Tank hire or purchase, self-bunded, with metering.
- Delivery, placement and removal, including a prepared base.
- Bollards or protection where it is near a traffic route.
- Signage and placards.
- Spill kits at each location, and replacement after use.
- Drip trays and drain covers.
- Fire extinguishers and their servicing.
- Notification or licence fees where applicable.
- Inspection and maintenance time.
- Removal of accumulated bund water, which may be contaminated and require disposal.
- A contingency for a spill, because the cost of even a modest contaminated soil removal is significant.

- Dangerous goods and hazardous chemicals management, usually inside the WHS or environmental response.
- Spill response and containment, which is a standard element of a construction environmental management plan — see construction environmental management plans.
- Refuelling procedures, particularly on sites near waterways or on water authority land.
- Site layout, where showing the fuel storage location relative to drainage demonstrates that the siting was considered.
- Client-specific requirements on operating sites, which frequently exceed the regulations and may prohibit on-site storage entirely.

- Have you totalled the dangerous goods held on site by class, including plant tanks, service trucks and jerry cans?
- Have you checked that total against the current thresholds for the jurisdiction of the site?
- Is notification, placarding, a manifest or a licence required, and has it been done before the goods arrived?
- Is the tank self-bunded and built to the applicable standard, with evidence from the supplier?
- Is the interstitial space monitored or inspected?
- Is there a drip tray at the dispensing point, since fittings sit outside the bund?
- Is there overfill protection and a working level indicator?
- Where a site-built bund is used, is it impermeable and kept free of rainwater?
- Is the tank sited away from waterways, drains and pits, with fall away from them?
- Is it separated from ignition sources, excavations and traffic routes, and protected where necessary?
- Is it on stable level ground, accessible to delivery and emergency vehicles, and out of flood-prone ground?
- Is the location marked on the site plan and in the emergency arrangements?
- Are spill kits at the tank, the refuelling point and on plant working near water?
- Are drain covers available and does the crew know where they are?
- Is there a written first action for a spill to land and a spill to water, and does everyone know who notifies the regulator?
- Is refuelling attended, with an automatic shut-off nozzle?
- Have you checked whether your service truck crosses a dangerous goods transport threshold?
- Are gas cylinders stored upright, secured, ventilated and with oxygen separated from flammable gases?
- Is there a hazardous chemicals register with current safety data sheets accessible at the point of use?
- Is all decanted product labelled?
- Is fuel reconciled, so a leak is not mistaken for theft?
- Have you confirmed with your broker whether pollution from a spill is covered?
- Is the whole installation priced in preliminaries rather than carried as a token figure?
